Make a disclosure—chattel
Disclosure of beneficial interest to seller
Chattel auctioneers with a beneficial interest in a sale must give the seller a completed Chattel auctioneer disclosure of beneficial interest to seller form (Form 10).
This includes if the buyer is:
- yourself
- a member of your family
- your business associate or employee
- an executive officer of your corporation.
Penalties apply if you fail to disclose your interest.
This is a requirement of the Motor Dealers and Chattel Auctioneers Act 2014.

Cooling-off period and statutory warranty to buyer
Chattel auctioneers must complete the Cooling-off period and statutory warranty (motor dealer or chattel auctioneer to buyer) form (Form 12) and give it to the buyer immediately before completing the contract of sale for a vehicle.
It includes details about:
- the cooling-off period
- the statutory warranty.
This is a requirement of the Motor Dealers and Chattel Auctioneers Act 2014.
