At an auction

The usual rules

You must display your name at the site of an auction. This rule is the same for chattel auctions or real property auctions.

Your name must be:

• written in clear and legible text
• placed in a conspicuous position in the premises
• clearly visible for the entire period of the auction.

A conspicuous position might be:

• by the entrance to the premises
• at an obvious location near the auction area.

Exemptions

Some limited exemptions apply—for instance, if:

• you are moving around a large, open outdoor area
• inclement weather would make it impossible to use the sign.

For example, this might be:

• an auction of heavy machinery on a large, open field causing the display to be moved continuously
• an outdoor auction in very strong winds.

In these cases, you must announce your name at the start of the auction.

Whenever you operate

You must be able to show a client, bidder or inspector a copy of:

• your licence
• your corporate licence
• any employee’s licence.

To do this, you must:

• keep a copy on all relevant premises for each licensee
• show it to the client, bidder or inspector if they ask to see it.
