Rent arrears
As a tenant, you must ensure the rent is always paid on time.
If you have any problems paying your rent, talk to your nearest housing office to make a repayment arrangement as soon as possible.
How we can help you
We will work with you to understand your circumstances and provide options to help you get your rent up to date.
We will do this by linking you with programs and services that will help you with budgeting, managing your money, and any other support you need.
We will also consider cultural information if provided.
Notice to remedy breach
If your rent is 2 weeks or more behind, you may receive a Notice to remedy breach.
This notice gives you 16 days to pay all of the rent you owe. If you can’t pay the full amount, talk to us about making an arrangement to repay your rent arrears over time.
Notice to leave
If you don’t pay your rent by the date stated on the ‘Notice to remedy breach’ or make a repayment agreement with us, we may send you a Notice to leave (Form 12).
This Notice gives you 18 days to pay all of the rent owing or move out of the house.
Termination order
If you don’t pay all of the rent owing or move out of the house by the date stated on the ‘Notice to leave’, we may apply to the Queensland Civil and Administrative Tribunal (QCAT) to end your tenancy.
QCAT will tell you the date of your hearing. You can attend and explain to the tribunal member why you haven’t paid your rent or made a reasonable agreement to pay rent arrears.
The tribunal member will make a judgement. If QCAT grants a termination order and warrant of possession, this means your tenancy is ended and you must move out by the set date.
