A recognised body is a corporation, an incorporated association or a charity registered under the Collections Act 1966.

A registered health practitioner is a person registered under the Health Practitioner Regulation National Law, other than as a student.

A residential facility means a place at which a child accommodation service is provided either:

  • by a prescribed  department
  • under funding provided by a prescribed department
  • under funding provided by the Commonwealth and administered by a prescribed department
  • under a licence under the Child Protection Act 1999
  • to children who are, under the Child Protection Act 1999, in the custody or guardianship of the chief executive of Child Safety—if the place is prescribed under a regulation made for this paragraph .

The prescribed departments are those responsible for:

  1. the care and protection of children
  2. community services
  3. disability services
  4. mental health.

A child accommodation service is a service with the main purpose of providing accommodation for children, but does not include:

  • care by an approved carer under the Child Protection Act 1999 (acting in that capacity)
  • the provision of accommodation under residential tenancy agreements under the Residential Tenancies and Rooming Accommodation Act 2008.

As per the Child Protection Act 1999, a licensed care service is a service that provides care for children under the chief executive’s custody or guardianship, and which is licensed to do so.

School means either:

  • a state school that provides primary, secondary or special education
  • a school that is accredited, or provisionally accredited, under the Education (Accreditation of Non-State Schools ) Act 2017.

An education and care service is any service providing (or intending to provide) regular education and care to children under 13, not including:

  1. a school giving full-time education to children—including the year before grade 1, but not including a preschool within a school, or a preschool registered as a school
  2. a preschool program delivered in a school, if it is delivered to fewer than 6 children and in a class where a full-time education program is also being delivered
  3. a personal arrangement
  4. a service that mainly provides instruction on a particular activity (e.g. sport, dance, music, culture, language or religious instruction)
  5. a service providing education and care to patients in a hospital or patients of a medical or therapeutic care service
  6. care provided under a child protection law of a participating jurisdiction
  7. a prescribed class of disability service
  8. a service of a prescribed class

Education and care service premises means:

  1. each place an education and care service other than a family day care service operates (or is going to operate)
  2. a family day care service’s
    1. office
    2. approved venue
    3. area(s) used to provide education and care to children as part the day care—or the areas used to provide access to these parts of the residence.

Child care is care of a child provided:

  • by someone other than a relative or guardian of the child
  • for reward

and

  • part of a service for regularly providing care of children.

A health service means a service for maintaining, improving, restoring or caring for a person’s health or wellbeing, including but not limited to a service:

  • providing personal care to a person who is ill, injured or otherwise infirm
  • providing respite care
  • provided by a practitioner of natural or alternative health care, such as hypnosis, naturopathy or acupuncture
  • providing massages, including a massage service for relaxation
  • provided by a health student in their capacity as a health student.

A health facility is a hospital, nursing home, community health facility or similar place, including a place used as a hospital, nursing home or community health facility on a temporary basis.

A counselling service is a service that provides or intends to provide professional help or guidance to persons to resolve personal, social or emotional problems or difficulties.

A support service is a service that provides emotional support, mentoring or pastoral care—it does not include legal advice or legal advocacy.

A funded non-government service provider is a service provider outside the government that receives recurring or one-off funds from the Disability Services to provide disability services (as defined in section 16 of the Disability Services Act 2006).

NDIS non-government service provider is defined in section 16A of the Disability Services Act 2006, however does not include a provider defined in section 41A.

An education provider is registered as a:

  • higher education provider under the Tertiary Education Quality and Standards Agency Act 2011 (Cwlth)
  • training organisation under the National Vocational Education and Training Regulator Act 2011 (Cwlth).

By relative, we mean the person’s:

  • parent, grandparent or great grandparent
  • brother or sister
  • uncle or aunt
  • niece or nephew
  • first cousin.

For an Aboriginal or Torres Strait Islander person, this may be a person who is regarded as one of these relatives under Aboriginal and/or Torres Strait Island tradition.

Where a person’s parent is not a natural parent, it also includes anyone who would be a relative mentioned earlier if the parent were a natural parent.

A religious representative is a member of an organised religion—or other religious group even if it is not or does not consider itself part of an organised religion—who either:

  • holds a position that is supported by the religion or group, including financial support, allowing them to:
    • devote themselves to promoting the religion or group's objects or values
    • hold themselves out as a representative of the religion or group
  • is training to hold such a position.

Sport means a form of human activity capable of achieving a result requiring physical effort or skill that, because of its nature or organisation, is competitive and is generally recognised as sport.

Active recreation is a form of physical exertion or activity done for relaxation or enjoyment, which is not based on formal competition.

An amusement park can be permanent or temporary, but it does not include amusement arcades.

Teaching means teaching, coaching or tutoring 1 child or more than 1 child at the same time.

Licensed residential facility is a licensed premises in which children reside (as defined in the Child Protection Act 1999).
