Party to the proceeding

A party is an individual, corporation or other entity that has:

  • started a civil or criminal court proceeding
  • had a civil or criminal proceeding started against them
  • later joined in a civil or criminal court proceeding as a party.

If a party appoints a legal representative to do a task they must do, or are allowed to do, the legal representative becomes the contact in the proceeding for the party they represent.

Supreme and District courts

Decisions for searching or copying civil documents are based on Rules 980 and 981 of the Uniform Civil Procedure Rules (UCPR) 1999.

To search or copy exhibits or subpoenaed material, you need the permission of the court as there is no authority given under the UCPR 1999.

Decisions for searching or copying criminal documents are based on Rules 29, 30, 31, 56, 56A and 57 of the Criminal Practice Rules 1999.

Magistrates Court

Decisions around searching and copying documents are based on section 154 of the Justices Act 1886 and Schedule 3 of the Justices Regulation 2014.

For searching and copying subpoenaed material and exhibits, Rules 3, 31, 56 and 56A of the Criminal Practice Rules 1999 may also apply.

Material produced by way of subpoena or summons —an object or document that was called to be produced before a court or judicial officer.

Verdict and judgment record (VJR) —a record of a person’s court result, containing the criminal charge, relevant part of legislation, name of the judicial officer, plea, verdict, sentence, judgment, and any other order.
