Report a breach of Manufactured Homes (Residential Parks) Act

The Manufactured Homes (Residential Parks) Act 2003 contains penalties for certain offences. These are called statutory offences.

We investigate all alleged statutory offences. If you suspect someone has committed a statutory offence under the Act, complete the breach notification form provided below.

Important!

Not all breaches of the Act are statutory offences. For example, a park owner who fails to provide mail facilities is breaching the Act. But there’s no penalty, so it’s a non-statutory offence.

Don’t report non-statutory offences here. Follow the Act’s dispute resolution processes or apply to the Queensland Civil and Administrative Tribunal (QCAT).

What you must include in the form

  • Your name and contact details – we accept anonymous reports but have fewer options for progressing issues that are raised anonymously
  • The name and address of the residential park you’re reporting
  • The facts of the situation with as much detail as possible (e.g. times, dates, places)
  • The section of the Act you believe has been breached (see the form for information about relevant sections)
  • Any action you’ve taken to try to resolve the issue
  • Copies of relevant documents or evidence to support your notification.

What happens next

After you submit the form, we’ll contact you to let you know we received it.

We will then assess the details you’ve provided, including:

  • the nature and seriousness of the allegations
  • when the incident occurred
  • the information and supporting documents you provide
  • whether the matter falls within our jurisdiction
  • whether it’s more appropriate for another agency to deal with the issue.

If we decide to investigate your report, we’ll prioritise it and assign it to an analyst. We’ll keep you informed about the progress of the investigation.

We might need to discuss the suspected breach with the park manager. We will release your details only with your consent or if required by law.

Possible outcomes of an investigation include:

  • taking enforcement action (if we find a breach), such as issuing a warning notice or starting prosecution
  • providing education and advice about fixing the issue to the park owner
  • referring the matter to another agency
  • taking no further action (if we find the legislation hasn’t been breached).
