Certain ‘non-development’ activities may be permitted in a declared fish habitat area if done in accordance with a Code of practice for the lawful use of physical, pesticide and biological controls in a declared fish habitat area (FHACoP01). No approval is required for these activities; however, pre-works notification is required.
The form needs to be completed at least 5 business days before works commence.

The personal information collected on this form will be used by the Department of Environment, Science and Innovation to administer the provisions for Fish Habitat Areas in accordance with the Declared Fish Habitat Area Code of Practice and Part 6 of the Fisheries Act 1994.

The personal information will be stored in department databases and will be retained as required by the Public Records Act 2008.
