We are not involved in any statutory warranty claims or able to compel reimbursement of any funding for repairs to any part/s of the vehicle.

If any repairs have been carried out between the time the Safety Certificate was issued and prior to us commencing an investigation, our inspection may not be warranted as any original defective items, or evidence, may no longer be obvious and evident.

A motor dealer is required to provide you with a Statutory Warranty for most light vehicles, except for trailers, motorcycles and commercial vehicles.

The Office of Fair Trading may be able to assist you with further enquires relating to warranties or financial reimbursements.

If you purchased the vehicle privately, you should seek independent legal advice as Safety Certificates carry no warranties.

If we find any defects on the vehicle, a defect notice may be issued to the registered vehicle owner. If a defect notice is issued, the vehicle may only be used as instructed by us and may not be used for everyday use until the defects are repaired to the standards required.

Following a review of the information provided by the complainant, we will gather evidence to determine if the Safety Certificate was issued on a defective vehicle. If evidence supports the complaint, the approved examiner who issued the Safety Certificate will be interviewed and appropriate compliance action taken.

We can only act against an approved examiner if it is proven , the examiner contravened the Transport Operation Road Use Management Act 1995 or the Code of Practice – Vehicle Inspection Guidelines.

We are not able to tell you what action has or will be taken against an examiner as this may contravene privacy legislation. When your case is finalised, you may be able to apply through the Right to Information unit for copies of documents relating to your case. Learn more about the Right to Information procedure.
