Application for adjudication

You are about to complete an application to ask for an adjudicators’ order.

Your application must meet certain legislative requirements. To help you complete the form correctly, you will be prompted along the way.

There are limitations on the parties to a dispute. You must have attempted self resolution before lodging your application and, in most cases, you should have also attempted conciliation with this office.

This form will take approximately 20-30 minutes to complete. You cannot save this form to complete at a later time. It must be completed in full before you exit this screen.

To complete this form you must have all the necessary information including the:

  • registered name of your body corporate
  • community titles scheme number
  • regulation module that applies to your body corporate.

If you do not have this information contact the Titles Registry on 1300 255 750 before you start to complete this form.

You will also need to provide the name and contact details of your body corporate secretary and body corporate manager (if you have one).

At the end of this process, a printable form will be generated with the information you have provided. You must then:

        If you are applying on behalf of your body corporate seeking the return of body corporate records or other property, you must attach a copy of the committee resolution the body corporate sent to the person currently holding the property. The committee resolution must say who the property is to be returned to and have allowed 14 days before lodging this application.

        If you are lodging this application as an owner/occupier or another individual seeking access to body corporate records, you must provide a copy of your written correspondence where you clearly requested specific documents or to inspect the records. This correspondence should have also included payment of the prescribed fee or an undertaking to the body corporate to pay the prescribed fee.
