1. Definitions

1.1 The following definitions apply to these Terms and Conditions:

a. Eligible Child means a child or young person who at the time of application:

  • is between the ages of 5 and 17 (inclusive); and
  • is a resident of Queensland; and

either:

  • holds or whose parent, guardian or carer holds a valid Centrelink Health Care Card or Pensioner Concession Card with the child’s name on it; or is referred under the referral process outlined in clause 4.

b. Eligibility Criteria means the criteria to be eligible to apply for a Voucher as outlined in clause 3.1.

c. Registered Sport or Recreation Club means a sport or recreation club that has been approved and is currently registered for the Get Started Vouchers program.

d. Agent Referral means a person who has been registered with the Department as a referral agent under the Get Started Vouchers program and in their professional capacity refers a child/young person to receive a Voucher and must be able to demonstrate, if requested, the reasons why the child/young person is referred, specifically in relation to needing financial assistance to join a club. 

Has known the child/young person being referred for at least 3 months; and is not:

  • an immediate family member of the child/young person applying for the Voucher; or
  • involved as a member or employee of the Registered Sport or Recreation Club

e. Voucher means a voucher issued under the Get Started Vouchers program for a value of up to $150, for membership and/or participation fees which can be redeemed at a Registered Sport or Recreation Club.

2. Application

2.1 These Terms and Conditions apply to the application for and use of a Voucher under the Get Started Vouchers program.

3. Eligibility Criteria

3.1 To be eligible to receive a Voucher, a child or young person must:

a. be an Eligible Child;

b. not have been issued with a Voucher in the current calendar year; and

c. have complied with the terms and conditions of a Voucher issued in the previous calendar year, if any. [NB: Where a parent, guardian or carer, or the Eligible Child has been asked by the Department to repay any funds in relation to a Voucher for the Eligible Child, then the Eligible Child will not have complied with the terms and conditions of the Voucher].

4. Referral process

4.1 To be eligible for referral through a Referral Agent, (where the child/young person is seeking to be eligible by the referral process):

a. the application for a Voucher must contain the name, position, organisation name, telephone number and email address of the Referral Agent; or

b. where the Referral Agent applies on behalf of an Eligible Child, the Referral Agent must have permission from the Eligible Child’s parent, carer or guardian prior to making the application.

4.2 The Registered Referral Agent will be responsible for providing details of how to apply for a Voucher when directing the parent, carer or guardian to apply for a Voucher.  This application will be for the use of one child or young person referred by the Registered Referral Agent.

5. Obligations for parent/guardian applicants

(this clause 5 applies to parent/guardians completing the application form (and clause 7 does not apply) – see 7 below if you are a Referral Agent applying on behalf of an Eligible Child)

5.1 In applying for a Voucher, you agree that:

a. you are the parent, guardian or carer of the Eligible Child;

b. the Eligibility Criteria are met;

c. all the information provided in the application process is true and correct; and

d. you will comply and ensure that the Eligible Child complies with these Terms and Conditions.

5.2 You can only redeem the Voucher with a Registered Sport or Recreation Club. The Department will not honour Vouchers redeemed with a non-Registered Sport or Recreation Club.

5.3 If you receive a Voucher, you agree to only use the Voucher to pay costs towards membership and/or participation fees with a Registered Sport or Recreation Club. The Vouchers must not be used for the costs of any other individual or associated items not covered by the membership and/or participation fees, including but not limited to jerseys, boots, playing equipment and travelling costs.

5.4 You acknowledge and agree that:

a. if the membership and/or participation fees are more than $150, you will be required to pay the difference;

b. if the membership and/or participation fees are less than $150, the Department will reimburse the club for the membership and/or participation fees only. The balance is not redeemable in cash or towards the membership and/or participation fees for another Registered Sport or Recreation Club;

c. the Vouchers are not exchangeable or redeemable for cash;

d. the Voucher is not transferable under any circumstance and can only be used for membership and/or participation fees for the Eligible Child named on the Voucher prior to the expiry date;

e. if the Voucher is not redeemed with a Registered Sport or Recreation Club by the expiry date stated on the Voucher, then the Voucher expires;

f. you may request in writing to the Department for a Voucher to be withdrawn in extenuating circumstances and where a Voucher has not been redeemed.  'Extenuating circumstances' may include injury, illness or where the Registered Sport or Recreation Club has not fulfilled their obligations under the Terms and Conditions of Get Started Vouchers. 'Extenuating circumstances' does not include when the parent, guardian or carer is unaware of the Voucher expiry date.  You may be asked to provide the Department with evidence to determine if 'extenuating circumstances' exist;

g. you will receive notification from the Department whether your request to withdraw a Voucher is approved and if approved, you will retain the confirmation provided by the Department;

h. if approved under 5.4g. above, after receipt of the written confirmation and provided that the relevant round for the Voucher is open when the request to withdraw a Voucher is made, you can submit an application in the next round. You are not able to submit an application for a Voucher in the same round that the withdrawn Voucher was issued.

i. you are responsible for making your own enquiries with the Registered Sport or Recreation Club to discuss membership and/or participation with the club you are interested in joining to find out team availability, any additional costs, times for training/playing, membership restrictions, and other club membership requirements;

j. you will still be required to complete and comply with the Registered Sport or Recreation Club’s membership/participation processes, rules and regulations;

k. there are only a limited number of Vouchers available, which are released in two rounds each year and the Vouchers will be issued on a first come, first served basis. The Department is under no obligation to make further Vouchers available;

l. vouchers can only be used to pay for membership and/or participation fees of a Registered Sport or Recreation Club joined after the date of issue of the Voucher;

m. once a Voucher has been collected by the club, the parent, guardian, carer or Eligible Child is not entitled to a refund of the membership and/or participation fee equivalent to the Voucher amount, if the Eligible Child does not participate in the sport or recreation activity;

n. where a club redeems a Voucher and the Eligible Child requests a transfer to another Registered Sport or Recreation club, then it is the decision of the club whether to transfer the Voucher amount to the new club; and

o. where the club agrees to a transfer of the redeemed Voucher amount, you are not entitled to a refund of or any part of the Voucher amount if the membership and/or participation are less than the Voucher amount, and you will be required to pay any difference in the membership and/or participation fees of the new club, if the redeemed Voucher amount being transferred is less than the membership and/or participation fees of the new club.

6. Parent/Guardian's sole responsibility

(this clause 6 applies to parent/guardians completing the application form (and clause 7 does not apply) – see 7 below if you are a Referral Agent applying on behalf of an Eligible Child)

6.1 In applying for and presenting a Voucher, you agree that you are solely responsible for:

a. ensuring that you understand these Terms and Conditions, including the Eligibility Criteria;

b. decisions taken in relation to costs, expenses, obligations or liabilities incurred in relation to, or as a result of joining, the Registered Sport or Recreation Club; and

c. confirming with the club prior to presenting the Voucher: the membership rules; participation opportunities available to the child or young person at the club; membership and/or participation fee inclusions and exclusions; attendance requirements; and additional costs and/or requirements with participating in the sport or recreation activity.

6.2 Without limiting anything elsewhere in these Terms and Conditions, the Department will not be responsible or liable to you as the applicant or the Eligible Child, to the maximum extent permitted by law, for any of the matters described in this clause 6.1.

7. Obligations for Referral Agent applicants

(this clause 7 applies to Referral Agents completing the application form (and clauses 5 and 6 do not apply) – see clauses 5 and 6 above if you are a parent/guardian applying on behalf of an Eligible Child)

7.1 In applying for a Voucher, you warrant and agree that:

a. you have permission as a Referral Agent from the parent, guardian or carer, and are applying on behalf of the Eligible Child;

b. the Eligibility Criteria are met to the best of your knowledge;

c. all the information provided in the application process is true and correct to the best of your knowledge;

d. you have discussed with the parent/guardian of the Eligible Child that they are responsible for meeting any membership and/or participation fees above $150, and that the Voucher and if the membership and/or participation fees are less than $150, the balance is not redeemable in cash or towards the membership and/or participation fees for another Registered Sport or Recreation Club;

e. you have discussed with the parent/guardian of the Eligible Child that they will need to confirm with the club prior to presenting the Voucher: the membership rules; participation opportunities available to the child or young person at the club; membership and/or participation fee inclusions and exclusions; attendance requirements; and additional costs and/or requirements with participating in the sport or recreation activity; and

f. you have discussed with the parent/guardian of the Eligible Child how their information and the Eligible Child’s information collected as part of the application process, will be used by the Department.

7.2 Without limiting anything elsewhere in these Terms and Conditions, the Department will not be responsible or liable to you as the applicant to the maximum extent permitted by law, for any of the matters described in this clause 7.1.

8. Use of information

8.1 Information supplied by the parent/guardian and Referral Agent as part of the parent/guardian, Referral Agent and the Eligible Child’s participation in the Get Started Vouchers program (including any feedback or survey results provided) will be kept confidential by the Queensland Government and will not be disclosed without consent, other than:

a. to provide to any government agency in conjunction with the parent/guardian, Referral Agent and the Eligible Child’s participation in the Get Started Vouchers program;

b. to the extent permitted or required by law;

c. to such of its officers or employees as it considers reasonably necessary or appropriate in connection with assessing the applicant's entitlement to, issuing and redeeming the Voucher, and the administration of the Get Started Vouchers program;

d. to its professional advisers on a confidential basis;

e. to its auditor for the purpose of any audit of the Department's financial records;

f. to the Department's responsible Minister or to the Parliament of Queensland (as the case may be);

g. to its contractor engaged for the purpose of evaluation of the Get Started Vouchers program;

8.2 The Department is collecting information during the application process to assess the Eligible Child’s eligibility for the Get Started Vouchers program and participation in the Get Started Vouchers program. The information collected may be used by the Department (or its contractors) to contact you for the purposes of gathering feedback or participating in a survey on the Get Started Vouchers program. The information collected will only be accessed by authorised employees or contractors of the Department. Some information will be collated in a statistical format and may be given to local government authorities or local Members of Parliament for the purposes of providing information about the Get Started Vouchers program. This information will not be disclosed to any other parties unless authorised or required by law.  If you have any questions regarding your privacy, please contact righttoinformation@hpw.qld.gov.au.

9. Verification

9.1 The Department reserves the right, at its discretion, to verify any information provided as part of the Application. Verification may include, without limitation, any or all of the following:

a. requesting the provision of additional information;

b. making enquiries with the relevant Registered Sport or Recreation Club;

c. making enquiries with the relevant Referral Agents; and

d. confirmation that the Eligibility Criteria have been met.

9.2 Parent/guardians must retain copies of all documents associated with receiving a Voucher under the Get Started Vouchers program for 24 months after receiving the Voucher, to allow for post-redemption verification if required.

9.3 Notwithstanding any other provision of these Terms and Conditions, the Department reserves the right to require additional information or clarification from parent/guardian of the Eligible Child, the Referral Agent or anyone else before proceeding to make a decision about whether to issue a Voucher or accept redemption of a Voucher.

10. Repayment obligations

10.1 The Department may require a parent/guardian to repay the Voucher amount redeemed, in the event that any information provided as part of, or accompanying, the Voucher application process is untrue, false or misleading.

10.2 The Department may, in its absolute discretion, decide that due to the existence of exceptional circumstances an amount repayable under clause 10.1 of these Terms and Conditions is not repayable. In making such a decision, the Department may require the parent/guardian to provide satisfactory evidence about the existence of exceptional circumstances.

11. Closure, suspension or variation of Get Started Vouchers program

11.1 The Department reserves the right, at any time, to:

a. vary these Terms and Conditions, including the maximum Voucher amount, the number of Vouchers available, the Eligibility Criteria, process for redeeming the Vouchers and Get Started Vouchers program requirements;

b. suspend the operation of, or close, the Get Started Vouchers program;

c. alter or change the number of rounds per year or the opening and closing date for each round; or

d. reduce or extend the period of the Get Started Vouchers program.

11.2 The impact on outstanding applications for Vouchers, and Vouchers not yet redeemed, will be considered before any such action is taken. Any changes to these Terms and Conditions or action taken to suspend or revoke the Get Started Vouchers program will be notified on the Queensland Government website at http://www.qld.gov.au/recreation/sports/funding/.

12. General

12.1 The Department is in no way responsible or accountable for any decisions made by the Registered Sport or Recreation Club at any time, nor is the Department liable for any injuries that may be sustained while participating in the sport or recreation activity. The Department expressly disclaims all liability, to the extent permitted by law, for any loss, damage or other consequence whatsoever where direct or indirect, which may arise from the Eligible Child joining the Registered Sport or Recreation Club and/or participating in the sport or recreation activity.

12.2 Parent/guardian’s must not assign or subcontract their rights and obligations under these Terms and Conditions or in relation to a Voucher, without the Department’s written consent.

12.3 No rights under these Terms and Conditions will be waived except by notice in writing signed by the parent/guardian and the Department.

12.4 The Get Started Vouchers program and all related documents are governed by the laws of the State of Queensland.

12.5 Where the Department has issued a notice to the email address provided as part of the Voucher application process (and stated on the Voucher), the notification will be deemed to have been received by you:

a. immediately, where delivered by hand;

b. immediately upon receipt of electronic transmission confirmation; or
