residential facility

A residential facility means a place at which a child accommodation service is provided either:

  • by a prescribed  department
  • under funding provided by a prescribed department
  • under funding provided by the Commonwealth and administered by a prescribed department
  • under a licence under the Child Protection Act 1999
  • to children who are, under the Child Protection Act 1999, in the custody or guardianship of the chief executive of the Department of Child Safety, Youth and Women (CSYW)—if the place is prescribed under a regulation made for this paragraph .

The prescribed departments are those responsible for:

  1. the care and protection of children—that is, CSYW
  2. community services—that is, Department of Communities, Disability Services and Seniors (DCDSS)
  3. disability services—that is (DCDSS)
  4. mental health—that is, Queensland Health.
