Remember your rights when nabbing that bargain during EOFY sales

The Office of Fair Trading (OFT) is reminding Queensland consumers of their rights as the end of financial year (EOFY) sales approach.

Fair Trading Executive Director Brian Bauer said if a product purchased didn’t meet consumer guarantees, regardless of whether it was full price or discounted for an EOFY sale, the consumer may be entitled to a remedy such as a replacement, repair or refund.

“Whether shopping in traditional ‘bricks and mortar’ stores, or online, consumers have the same rights under the Australian Consumer Law (ACL), even if a product is on sale,” Mr Bauer said.

“It is illegal for stores and online sites, to display ‘no refunds’ signs, including on sale items, because they suggest that refunds are not possible under any circumstance, which is not the case.

“If a product is faulty or deemed dangerous, or if it doesn’t perform as expected, shoppers have rights under the ACL.”

The OFT recommends the following tips when considering a purchase at an EOFY sale:

  • Ask questions, shop around and compare offers before you buy
  • Keep a copy of all receipts and anything you sign such as layby agreements
  • Be aware of the full cost of the item including extra charges, taxes or additional shipping and handling fees when purchasing online
  • Use a trustworthy third party payment service if purchasing online
  • Read and understand the terms and conditions of the sale before making a payment, especially when purchasing online or signing up to a layby agreement
  • Make secure payments to protect against fraud and unauthorised credit card transactions. If paying by credit card and something goes wrong, a chargeback from your bank may be possible.
