Gold Coast property agent fined for failing audit requirements
09 April 2019
A Surfers Paradise resident letting agent has been fined in the Southport Magistrates Court yesterday (8 April 2019) following an Office of Fair Trading (OFT) investigation.
Cheryl Joy Harwood, the on-site property manager of Cypress Avenue Apartments, was fined $1,500.
The court heard the OFT conducted an investigation into Ms Harwood after the agent failed to lodge a trust account audit report for the period of July 2017 to January 2018.
Under the Agents Financial Administration Act 2014, agents must have their trust accounts audited annually and lodge them with the OFT.
The matter was heard ex-parte. In sentencing, the court considered Ms Harwood’s lack of cooperation throughout the OFT’s investigation and continued non-compliance.
Industry participants and consumers can report suspected misconduct by agents to the OFT by lodging a complaint at www.qld.gov.au/fairtrading.
