Conciliation application

You can complete an application for conciliation with us on this page. But first, we cover some extra information you should know.

Before you apply

Before you start the form below, make sure you understand these points about conciliation.

Even after you have lodged an application with our office, you can still try to reach an agreement with the other party. You can withdraw your application at any time by telling us in writing.

Fees

It will cost you money to apply and fees are generally not refundable.

Your application will not be referred to a conciliator until the application fee has been paid, or a fee waiver application has been approved.

Legal requirements

Your application must meet strict legal requirements to progress. Your application will be assigned to a case manager who may ask for

  • more information or clarification
  • you to make amendments
  • you to resubmit all or part of your application if it does not meet requirements.

Case managers can’t give you legal assistance or tell you how to word your application.

Time frames

How quickly a matter progresses depends on many factors. As a guide, 75% of conciliation applications in 2023 were resolved within 9 weeks of lodging.

Common issues that cause lengthy delays include:

  • seeking multiple outcomes where the legal basis is not clear
  • providing a large amount of attachments without clear
    • relevance
    • indexing or referencing
  • not providing evidence of attempts at internal resolution.

Completing the application

Your application must meet certain legislative requirements. To help you complete the form correctly, you will be prompted along the way.

There are limitations on the parties to a dispute. You must also have attempted self resolution before lodging your application.

This form will take approximately 20 minutes to complete. You cannot save this form to complete at a later time, it must be completely filled out before you exit this screen.

To complete this form you must have all the necessary information including the:

  • registered name of your body corporate
  • community titles scheme number
  • regulation module that applies to your body corporate.

You will also need to provide the name and contact details of your body corporate secretary and body corporate manager (if you have one).
