Succession of tenancy
Sometimes we may transfer the tenancy of a property to someone else, or add another person as well as the person whose name the property is under on the State Tenancy Agreement. This is called succession of tenancy. A new State Tenancy Agreement will need to be signed.
When is a succession of tenancy needed?
A Succession of Tenancy is needed when joint tenants separate, or a joint tenant passes away.
If you want to apply for a Succession of Tenancy for other reasons (e.g. adding an additional tenant or a sole tenant moves out or passes away) discuss your situation with staff at your nearest Housing Service Centre.
What do I do if one of the legal tenants moves out?
Let us know within 28 days. The tenant leaving the property needs to complete a Form 13 (Notice of Intention to Leave) to remove their name from the tenancy agreement.
If your co-tenant cannot be located to sign the form, discuss the situation with staff at your nearest Housing Service Centre. You will need to sign a new State Tenancy Agreement.
What do I do if a joint tenant passes away?
Tell us within 28 days of the person passing away. You will need to supply proof of the death, such as a notice from the newspaper, a death certificate, funeral director's account or a letter from the doctor. The rent will be re-assessed and the remaining tenant will need to sign a new State Tenancy Agreement.
What happens next?
We will contact you after you lodge the forms and documents to transfer the tenancy to your name. If approved, you will be asked to make an appointment at your nearest Housing Service Centre to sign the new State Tenancy Agreement.
Does my rental account number change?
Yes. When a Succession of Tenancy is completed, the account in the original tenant name(s) is closed. The new account will be in the name of the new tenant(s)—the same names that are on the new State Tenancy Agreement.
Will my rent change?
Yes. A full rent review will be conducted based on the current income of all household members.
What happens if a tenant in the household gets married or changes their name?
Contact your nearest Housing Service Centre. You will need to supply a copy of the Marriage Certificate or Deed Poll registration for the department to change the name. You do not need to sign a new tenancy agreement.
What do I do if I want to add a tenant to the agreement?
If you want to add a tenant to your tenancy agreement they will need to fill in a Succession of Tenancy Request (PDF, 56KB).
Their eligibility will be assessed and if eligible, all tenants will need to sign a new State Tenancy Agreement. If the person is not eligible they will not become a tenant but can still live in the property as a resident. Contact your nearest Housing Service Centre for more information.
