Your responsibilities
As the owner of a manufactured home in a residential park, you must:
- only use the site as a home (place of residence)
- only use the park’s common areas for purposes of residential use
- pay your rent and other charges payable under the site agreement to the park owner
- keep your manufactured home in a state of cleanliness, repair and make sure it is fit to live in
- comply with the site agreement and all park rules.
You must not:
- use the site or common areas for illegal purposes, or allow guests or tenants to do so
- rent your site to anyone unless the site agreement allows this, not even temporarily. If you would like to rent your site out temporarily, you must tell the park owner the new temporary tenant’s name and period of tenancy as soon as possible
- intentionally or recklessly damage or destroy the park’s communal facilities, or allow guests or tenants to do so
- make any alteration to your home that is visible from the outside of the home, or make any addition to your home unless the park owner gives written consent.
Additionally, as a home owner under a site agreement, you must comply with standards to ensure respect for the rights of others.
Residential park home owners, tenants and guests must:
- respect the peace, comfort and privacy of other residents
- respect the right of the park owners and staff to work in an environment free from harassment and intimidation
- uphold the occupational health and safety of people working in the park.
Park owner responsibilities
The park owner for a residential park must:
- take reasonable steps to ensure a home owner has quiet enjoyment of the home owners site in the park and in the common areas
- prepare and maintain an emergency plan for the park which details the procedures for an emergency response including for the
- evacuation of home owners
- notification of emergency services
- arranging for medical treatment
- communication to co-ordinate the emergency response
- ensure a maintenance and capital replacement plan is prepared and maintained for the park.
The park owner can’t restrict any visitor of a home owner or other resident, at the site or in a common area in the park, without a reasonable excuse – particularly a visitor who is providing a health or community service and is suitably qualified.
Emergency vehicles must be able to access the residential park at all times, unless there’s good reason they can’t.
