Appointment of a motor dealer or chattel auctioneer

Fill out the Appointment of a motor dealer or chattel auctioneer form (Form 9) to appoint or re-appoint a motor dealer or chattel auctioneer.

A completed and signed copy of this form must be given to the client before the motor dealer or chattel auctioneer sells the client's vehicle or goods.

This is a requirement of the Motor Dealers and Chattel Auctioneers Act 2014.

Appointment of a property agent, resident letting agent or property auctioneer

Fill out the Appointment of a property agent, resident letting agent or property auctioneer form (Form 6) to appoint or re-appoint an auctioneer (real property).

A completed form must be given to the client before the agent performs any service for them.

This is a requirement of the Property Occupations Act 2014.

Fees: Nil

Changes to this form are coming

From 1 May 2024, 2 separate forms—for residential and commercial property appointments—will replace the current single appointment form. You'll need to use the new forms for new appointments from that date. It won't affect existing appointments.

Property auctioneer disclosure of beneficial interest to seller

Property auctioneers with a beneficial interest in the sale must give the seller a completed Disclosure of beneficial interest form (Form 7).

This is a requirement of the Property Occupations Act 2014.

Fees: Nil

Disclosure of interest to potential buyer

Property auctioneers must show a potential buyer the Disclosure to potential buyer form (Form 8) to disclose their interests, including:

  • a relationship with any third party you've referred the buyer to
  • any commission you get from or pay to that third party
  • your interests in the property (if you're a property developer).

Penalties apply if you fail to disclose your interest.

This is a requirement of the Property Occupations Act 2014.

Chattel auctioneer disclosure of beneficial interest to seller

Motor dealers and chattel auctioneers with a beneficial interest in a sale must give the seller a completed Chattel auctioneer disclosure of beneficial interest to seller form (Form 10).

This includes if the buyer is:

  • yourself
  • a member of your family
  • your business associate or employee
  • an executive officer of your corporation.

Penalties apply if you fail to disclose your interest.

This is a requirement of the Motor Dealers and Chattel Auctioneers Act 2014.

Chattel auctioneer or motor dealer cooling-off period and statutory warranty for buyer

Motor dealers and chattel auctioneers must complete the Cooling-off period and statutory warranty (motor dealer or chattel auctioneer to buyer) form (Form 12) and give it to the buyer immediately before completing the contract of sale for a vehicle.

Individual licence

You can apply online for an auction industry licence as an individual—select 'Fair Trading Individual New Application'.

You can also fill out the Application for an individual's licence form (Form 1-1) and return it to us:

Corporation licence

Fill out the Application for a corporation's licence form (Form 1-2) to apply for an auction industry licence as a corporation.

Return it to us:

You can't apply online.

This is a requirement of the Property Occupations Act 2014 and the Motor Dealers and Chattel Auctioneers Act 2014.

Substitute licensee

Fill out the Application to appoint a substitute licensee form (Form 11) to apply to:

  • appoint a substitute licensee to work for more than 30 days
  • extend the substitute licensee's appointment period.

Note: You can't renew a corporate licence online. You can only renew it in person or by post.

Write to us at an OFT contact centre or by email to ILU@justice.qld.gov.au to request to:

  • change or remove licence conditions
  • deactivate or reactivate a licence.

Please include as much detail as possible, including your licence number.

There are no forms to fill out.

Fees apply

When reactivating a licence you may need to pay a pro-rata renewal fee and a criminal history check fee, depending on whether you've previously renewed an inactive licence. We'll let you know the fee you need to pay once we receive your application.

Mutual recognition of an interstate or New Zealand licence

Current interstate or New Zealand licence holders can fill out the Application for mutual recognition of occupational licence form (Form 1) to apply for a Queensland licence.

This is a requirement of the Mutual Recognition (Queensland) Act 1992 and the Trans-Tasman Mutual Recognition (Queensland) Act 2003.

Replace a licence

Apply to replace a licence using the OFT online portal—select 'Fair Trading Request Form'.

Otherwise contact us by post or email as soon as you notice your licence is lost, stolen, damaged or destroyed.

Request a licence extract

You can request a licence extract online using the OFT online portal—select 'Fair Trading Request Form'.

Otherwise contact us for an extract.

The extract will show:

  • the name of each person who holds the licence
  • their registered business name (if any) and place of business
  • the status of the licence—current, expired, refused, cancelled or suspended
  • their licence number and class.

Lodge a trust account audit report

You can submit your trust account report (prepared by a qualified auditor):

Open, close or change the name of a general or special trust account

Fill out the Notification of opening, closing or change of name of trust account form (Form 5) to tell us if you:

  • open a new trust account
  • change your trust account details
  • close your trust account.

This is a requirement of the Agents Financial Administration Act 2014.
