  • a relationship with any third party to whom you refer the buyer
  • any commission you get from that third party

  • your interests in the property (if you’re a property developer).

Give this form to a seller if you have a beneficial interest in the sale, such as if the buyer is:

  • yourself
  • a member of your family

Real estate warning statement

Form 30c – Property Agents and Motor Dealers Act 2000

You must attach this warning statement to the top of the sale contract and draw the buyer’s attention to it before they sign anything. It warns them to:

  • understand about the cooling-off period
  • get independent legal advice
  • find an independent valuer to value of the property.

Penalties apply if you fail to attach this statement.

Information sheet (body corporate information)

Form 14 – Body Corporate and Community Management Act 1997

You must attach this to the sale contract for purchases in a body corporate or community title scheme. It warns the buyer about:

  • their rights and responsibilities
  • the body corporate’s rights and responsibilities
  • specific matters that they should investigate before signing the contract.

Lawyer's certifications

Form 32a – Property Agents and Motor Dealers Act 2000

If you’re a lawyer, you must fill out this form if your client wishes to waive or shorten a cooling-off period. This will confirm that you:

  • are independent of the seller or seller’s agent
  • will not receive any benefit from the sale
  • have explained the effect of the contract to the buyer
  • have also outlined the purpose and nature of the certificate.

Fill out this form to apply for an exemption from certain requirements when selling empty land.

You can apply if:

  • you’re buying or selling land
  • there are 5 subdivisions or fewer (from the original allotment).

Requesting a licence extract

There is no form to request an extract from a licence search. Please contact us if you need a search extract.

The record will show:

  • the name of each person who holds the licence
  • their registered business name (if any) and place of business
  • the status of the licence—current, expired, refused, cancelled or suspended
  • their licence number and class.

Application for approval as an auditor

Form 14 – Property Agents and Motor Dealers Act 2000

Fill out this form for us to approve you to audit a regulated trust account. You are automatically approved (and do not need this form) if you:

  • hold a valid registration under the Corporations Act 2001
  • work for a registered auditing company
  • are a certified member of
    • CPA Australia (using the letters CPA or FCPA)
    • the Institute of Chartered Accountants in Australia (using the letters CA or FCA)
    • the Institute of Public Accountants (using the letters MIPA or FIPA).

All other auditors must fill out this form.

You will need to use the approved forms under the new legislation.

They will be easier to use because of:

  • fewer forms in total
  • simpler forms to fill out.

For now, you still need to use the Property Agents and Motor Dealers Act 2000 forms.

Specific changes

A single appointment form will replace the 7 current forms.

We will also remove:

  • the warning statement as a separate form (it will form part of the sale contract)
  • the lawyer's certification form for waiving a cooling-off period
  • the application forms for
    • property developers (this category of licence is being abolished)
    • pastoral houses (these types of licence will transition into other licence categories).
