Appointment of motor dealer to sell a motor vehicle on consignment

Important pre-purchase information cooling-off period

Notice of statutory warranty

Form 38a-1 – Property Agents and Motor Dealers Act 2000

Give this notice to customers who buy second-hand vehicles to advise them of their statutory warranty rights. You must do this unless they buy an exempt vehicle.

Option to purchase during cooling-off period

Form 39 – Property Agents and Motor Dealers Act 2000

Use this form if a customer would like an option to buy a car that:

  • you have sold to another buyer
  • is still subject to a cooling-off period.

This means that:

  • the option holder can buy the vehicle if the first buyer’s contract falls through
  • their option will lapse if the first buyer’s contract does not fall through.

Guarantee of title to buyer—by an auctioneer

Give this notice to the successful bidder at an auction to guarantee that clear title of ownership will pass to that person.

There is no form to request an extract from a licence search. Please contact us if you need a search extract.

The record will show:

  • the name of each person who holds the licence
  • their registered business name (if any) and place of business
  • the status of the licence—current, expired, refused, cancelled or suspended
  • their licence number and class.

Application for approval as an auditor

Form 14 – Property Agents and Motor Dealers Act 2000

Fill out this form for us to approve you to audit a regulated trust account. You are automatically approved if you:

  • hold a valid registration under the Corporations Act 2001
  • work for a registered auditing company
  • are a certified member of
    • CPA Australia (using the letters CPA or FCPA)
    • the Institute of Chartered Accountants in Australia (using the letters CA or FCA)
    • the Institute of Public Accountants (using the letters MIPA or FIPA).

All other auditors must fill out this form. There are no fees to pay when lodging this form.
