Fees for body corporate dispute applications

You must pay a fee if you are applying for adjudication, conciliation or a referee’s order.

We can only process applications once the fee has been paid.

The fees and charges increase on 1 July each year. On 1 July 2023 our fees and charges increased by 3.4% in line with the government's indexation policy.

You do not have to pay GST.

The conciliation or adjudication fees apply to schemes that operate under the Body Corporate and Community Management Act 1997 (BCCM Act) and have a community management statement (CMS) recorded.

If your body corporate does not have a CMS recorded, the application fees for a referee’s order will apply.

Application fees for conciliation or adjudication

The prescribed application fees for conciliation and adjudication are:

  • $110.30 for a conciliation application
  • $110.30 for an adjudication application (final order only)
  • $231.90 for an adjudication application (interim and final order)

If you can’t afford to pay the fee for conciliation or adjudication, you can apply to the Commissioner to waive the application fee.

Inspecting adjudication applications and submissions

During the adjudication process an ‘interested person’ can see or get copies of the application and/or submissions, and reply to submissions.

An interested person is usually:

  • an applicant
  • a respondent
  • someone affected by the dispute
  • the body corporate
  • a committee member
  • a person who made a submission in response to the application.

The fees to inspect the application and/or the submissions are:

  • $20.05 per hour or part of an hour
  • $78.65—maximum fee for a day.

Fees for copies of the application and/or submissions, and the reply to submissions are:

  • $2.30 per page for less than 20 pages
  • $1.90 per page for 20 to 50 pages
  • $1.40 per page for more than 50 pages.

How to get copies of submissions

Write to us to inspect or get copies of the adjudication application and/or submissions by emailing bccm@justice.qld.gov.au.

You must include the application reference number in your written request and clearly show what document you want. After submitting your request for copies submissions, you will be told the correct fee.

Application fees for a referee’s order

The prescribed application fees for referee’s orders are:

  • $110.30 for a referee application (final order only)
  • $231.90 for a referee application (interim and final order)
  • $110.30 for giving a notice of appeal against the order of a referee.

How to get copies of submissions

There are no fees for the applicant to receive copies of submissions. The referee sends copies of the submissions to the applicant once they have been received.

Once submissions are received, the referee usually gives the applicant the chance to respond to them.
