Lawful use of premises

Information for Queensland public housing tenants.

You must make sure that any activity you do in your home:

  • is legal
  • does not cause a nuisance
  • allows neighbours to enjoy reasonable peace, comfort and privacy.

This is called lawful use of premises.

Running a business from home

If you want to run a business from your home, you must follow the above 3 points and:

  • you must live in your home
  • your business must comply with Local Government (Council) Laws and any regulations
  • the activities of the business must not damage the property
  • you must take out appropriate insurance
  • you must declare income from the business at your rent reviews.

Tenants can request approval to conduct a business from their premises. Where a resident or dependent is responsible for running a business from the property the application to have the business there must be submitted with the signature of the legal tenant(s) and the household member.

We will issue you with a Notice to Remedy Breach (RTA Form 11) if you do not follow these conditions.
